New Delhi, 4 December: The Rouse Avenue Court in Delhi has again deferred its order on framing charges against the accused in the Land for Job case filed by the Central Bureau of Investigation (CBI). Special Judge Vishal Gogna ordered the judgment to be pronounced on 8 December. The court had earlier deferred its order on 10 November. The court had reserved its order on framing charges in the CBI case on 25 August. During Thursday's hearing, Lalu Yadav, Rabri Devi, and Tejashwi Yadav were not present. Their lawyer, Maninder Singh, who was representing the three, requested exemption from appearance in court today, which was allowed by the court. Lalu Prasad Yadav has filed a petition in the Delhi High Court seeking quashing of the FIR registered by the CBI in this case and a stay on the trial court proceedings. The High Court will hear the petition on 25 September. Arguing on behalf of Lalu Yadav, Kapil Sibal contended that the necessary sanction for prosecuting the case was not obtained. Consequently, the entire investigation is illegal. The investigation cannot be initiated without the necessary sanction. Sibal further stated that the entire proceedings in this case are flawed. During the hearing, the CBI's lawyer said that Lalu Yadav was deliberately not arguing on framing charges in the trial court. The trial court will complete the arguments on 9 September. The court further stated that the necessary sanction is required only in cases under the Prevention of Corruption Act, not in cases under the Indian Penal Code. The Supreme Court had refused to stay the trial court proceedings on 18 July. On 7 October 2022, the CBI had filed a charge sheet against 16 accused, including Lalu Prasad Yadav, Rabri Devi, and Misa Bharti, in the job-for-land case. The trial court had taken cognizance of the charge sheet filed by the CBI on 25 February. On 7 June 2024, the CBI filed its final charge sheet in the case, naming 78 people as accused. Of these 78 accused, 38 are railway job aspirants.
